These Terms of Service ("Terms") govern your use of the website localtradesai.com and the services provided by Local Trades AI ("we," "us," or "our"). By using our website or subscribing to our services, you agree to these Terms.

1. The Service

Local Trades AI provides AI-powered phone answering, appointment scheduling, SMS follow-up, review management, and related communication services ("the Service") to trades and home-service businesses. The Service is provided on a monthly subscription basis according to the plan you select.

2. Accounts & Eligibility

You must be at least 18 years old and authorized to act on behalf of the business you represent. You agree to provide accurate information during onboarding and to keep it current.

3. Subscriptions, Billing & Cancellation

Plans are billed monthly in advance. Pricing is listed on our website and confirmed at signup.
Promotional offers (such as a free first month) apply as described at the time of signup.
There are no long-term contracts. You may cancel at any time, effective at the end of the current billing period. No prorated refunds are issued for partial months.
Plans include a fair-use allotment of AI call minutes as described in your plan; sustained usage materially above the allotment may require an upgraded plan or incur overage charges, which we will communicate to you in advance.

4. Your Responsibilities

You are responsible for the accuracy of the business information, calendars, and integrations you connect to the Service.
You must use the Service in compliance with applicable laws, including telemarketing, call-recording, and SMS regulations applicable to your business and customers.
You agree to obtain any consents required from your customers for communications sent on your behalf through the Service.
You will not use the Service for unlawful, deceptive, or abusive purposes, or attempt to reverse engineer, resell, or disrupt the Service.

5. AI Disclosure

The Service uses artificial intelligence to answer calls and communicate with callers. While we work to make the AI accurate and reliable, AI-generated responses may occasionally contain errors. You are responsible for reviewing bookings and communications and for the final delivery of your business's services to your customers.

6. Intellectual Property

We retain all rights to the Service, including software, prompts, configurations, designs, and documentation. You retain all rights to your business data. You grant us a limited license to process your data solely to provide the Service.

7. Third-Party Services

The Service relies on third-party providers (such as telephony carriers, SMS networks, and calendar platforms). We are not responsible for outages or failures of third-party networks beyond our reasonable control.

8. Disclaimers

The Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted or error-free, or that every call will be answered or every appointment captured. We make no guarantee of specific revenue outcomes; any figures presented are estimates based on typical usage.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or related to the Service will not exceed the amounts you paid to us in the three (3) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost business opportunities.

10. Termination

We may suspend or terminate the Service for material breach of these Terms, non-payment, or unlawful use. You may cancel as described in Section 3.

11. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in North Carolina.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Service after changes take effect constitutes acceptance.
